One of the men responsible for a racial bashing that led to Australia's worst race riot has been refused bail in court

Justin Norrie:

Mahmoud Eid, 19, from Regents Park, appeared via video link at Central Local Court charged over an attack on three men outside North Cronulla Surf Club on December 7. He applied for bail and was refused.

The brawl followed an attack on Cronulla surf lifesavers three days earlier.

The brawl sparked a text message campaign that led to a race riot involving thousands of people at Cronulla beach four days later. Two days of revenge attacks followed the riot.

Eid and another accused, Wael Tahan, were with a group of up to 30 friends outside the North Cronulla Surf Club about 4pm on December 7, according to police facts tendered in court.

They were allegedly insulted by a group of three local men, Robert Duncan, Adam Warner and Don Johnson, who had been speaking with lifesavers moments earlier.

Warner made loud remarks "that would be seen as demeaning and insulting towards the Middle Eastern community", according to police.

A fight broke out during which the two alleged attackers and their friends repeatedly punched and kicked Warner and Duncan in the face. Warner received a fractured nose and ribs, bruising and cuts. Duncan received a fractured eye socket, a displaced spinal disc, cuts and bruising.

A bystander, Michael Crutcher, was allegedly punched in the back of the head by Eid when he tried to intervene.

The court was told Eid planned to plead not guilty to charges of maliciously inflicting grievous bodily harm, assault and affray.

Eid would also plead not guilty to three other charges relating to a revenge attack, at Cronulla, on the morning of December 12, his lawyer said.

In separate facts tendered by police, Eid and Wahan are accused of another savage bashing when they allegedly travelled to Cronulla with two co-accused, Michael Ceissman, 21, and Steven Elmir, 19, hours after the riot, at about 12.30am on December 12.

There was "a pattern of behaviour by the accused in committing racially-based violent crimes in the area of the Cronulla Beach", according to a police statement.

Police say the group piled out of a car on the corner of Hume Road and Elouera Road to launch an unprovoked attack on Jake Schofield, kicking and stomping him and stabbing him twice in the back.

Schofield suffered serious injuries, including a dislocated jaw, and still experiences short-term memory loss.

All four men are charged with robbery in company causing wounding or grievous bodily harm, maliciously inflicting grievous bodily harm with intent to do so and affray.

Part of Mr Schofield's mobile phone was found in Eid's possession, police allege, and blood with the Mr Schofield's DNA profile was found on the shoe of Tahan.

Eid, Ceissman and Elmir all applied for and were refused bail. Wahan will appear on all charges at Central Local Court next Wednesday.

Magistrate Allan Moore described the police case against the first three as strong. Each had shown a tendency towards unprovoked violence that should undermine their application for bail, he said.
