The Netherlands wants clarification on a European Human Rights Court ruling in which the court forbade the deportation of a Somali man

Justice Minister Ernst Hirsch Ballin fears the court’s argumentation for the verdict could have major consequences for the Dutch asylum policy.

He is appealing the court decision in order to get a definite answer on that.

The European Count ruled in January that the Netherlands was not allowed to deport the asylum seeker in question because he belonged to an oppressed minority in Somalia.

The decision seems to indicate that the Netherlands may no longer base asylum decisions on the individual applicant but rather that it must deal with asylum seekers as members of groups.

“If that is the case it could have far-reaching consequences,’ Hirsch Ballin said on Friday after the weekly cabinet meeting.
