Britain: A convicted Iraqi sex offender who escaped deportation claiming his homeland was too violent brutally raped a young student four months later

Kurd Ramzi Borkan had already been jailed for first groping a 14-year-old schoolgirl, and then imprisoning a former lover and her new boyfriend in a fit of jealousy.

In a sequence of events that ended with what the judge branded as his "mind-boggling" release, the 36-year-old was transferred to a mental hospital half-way through his 24-month sentence imposed for the later offence before being sent to a deportation centre.

London's Blackfriars Crown Court was told he then successfully appealed against the Home Office's decision to return him to war-torn Iraq arguing it would "infringe his human rights".

In August last year Baghdad-born Borkan was allowed to walk the capital's streets once more, albeit under a "care in the community" regime.

Last December he decided to rape a woman and went hunting.

He strolled into the Japanese Centre in London's Piccadilly, saw a 21-year-old Japanese student studying the accommodation board and told her he had a room to let.

The defendant convinced her to return his flat in Ladbroke Grove, west London, where he attacked her. During the "terrifying" ordeal which lasted several hours, he subjected her to various sexual indignities before twice raping her.

He even filmed part of the attack on his mobile phone, possibly as "some sort of memento or trophy of the occasion".

Borkan, who admitted two counts of rape, repeatedly shouted from the dock as Judge David Martineau jailed him for eight years and told him: "This was in my view a fully pre-meditated offence, just like the attack on the 14-year-old.

"There were two rapes and that is a seriously aggravating feature of this incident. You subjected this young woman to a painful and humiliating sexual indignity...and you kept her against her will in that flat for several hours.

"I regard you as posing a significant risk of serious harm to young women. There must be therefore a sentence of imprisonment for public protection."

Dealing with the question of deportation, the judge said "the mind boggles" when considering the reason he escaped being kicked out of Britain.

"I know you were born in Baghdad, but why can't you be deported to the Kurdish area in northern Iraq which I understand does not have the sort of violence that is found in the rest of the country."

He added that, in any event, he would still be recommending his deportation following his latest sentence. In addition, he would have to register as a sex offender for life.

The court heard Borkan first came to Britain on a bogus Indian passport in 1992.

Five years later, he attacked the 14-year-old, who was taking part in a residential school course at Imperial College, London.

He managed to get into a hall of residence unchallenged and found her in a kitchen.

He was later jailed for four months and put on the sex offenders' register for seven years.

In 1997 he spotted a former lover and her new partner leaving a nightclub. He followed them to her flat, broke in, threatened them with a knife and, while keeping them prisoner for several hours, attacked the boyfriend.

This time he was jailed for two years for false imprisonment and actual bodily harm and recommended for deportation.

Twelve months into his sentence he was admitted to a mental hospital. His transfer to an immigration centre to await deportation, appeal and release followed.

Dealing with the rape, Tom Wilkins, prosecuting, said Borkan began to show his true colours after inviting his victim back to his flat and cooking her a meal.

He told her he wanted her to live with him, repeatedly refused to let her leave, and then ordered her to strip before forcing her into the bathroom.

There he shaved her genital area, washed her and then dragged her back to the bedroom where she was raped.

Mr Wilkins said once he had finished and fallen asleep, the distraught woman quietly gathered her clothes and other belongings and fled.

Borkan was arrested at his flat a few hours later.
